All photographs, graphics, digital assets, or digital images and rights relating to them, including copyright and ownership rights in the media in which they are stored, remain the sole and exclusive property of mine.
Customer is granted the right to reproduce, publicly display, and distribute them only for promotional or advertising purposes directly related to the sale of the property. Any use that is not directly related to the sale of the property must be with the express permission of me and the payment of additional fees, unless otherwise agreed to in writing.
I am an independent contractor, and that neither me, nor my employees or contract personnel are, or shall be deemed to be, employees of Customer. No agency, partnership, joint venture, or employee-employer relationship is intended or will be created.
Client should understand that there can be times services cannot be completed due to flight restrictions (applies to aerial photography) or weather. In those circumstances, the decision about shooting is up to the Photographer. No reschedule fee will be charged in the event of bad weather. Reschedules will be subject to availability. If additional outdoor photos are required on a better weather day, a re-shoot fee will apply.
